Terms of Service

These Terms of Service govern your use of the Stratique website, your purchase of digital products, and your engagement of services from Anya Canise trading as Stratique (ABN 15 634 234 628), operating at www.stratiqueconsulting.com. By purchasing a product or engaging a service, you agree to be bound by these terms.
Please read these terms carefully before completing your purchase or booking.
1. About Us
Anya Canise is a sole trader operating under the business name Stratique, based in Melbourne, Victoria, Australia. References to "we", "us", and "our" throughout these terms refer to Anya Canise trading as Stratique.
2. Our Products and Services
Stratique offers two categories of offerings:

AI-powered GPT tools, PDF's, email marketing frameworks, guides, and related digital resources.

2.2 Services
Professional email marketing services delivered by Anya Canise. Services include but are not limited to:
1:1 Email Strategy Sessions
Email marketing audits
Email marketing projects including funnel builds, campaign creation, and sequence writing
Ongoing email marketing retainers
Consulting and advisory work
Services are delivered via a combination of video calls, written communications, and direct platform work depending on the scope of engagement. High-value service engagements including retainers and projects are governed by a separate client agreement which takes precedence over these Terms of Service where any conflict exists.
3. Digital Product Access and Delivery
Upon successful payment, you will receive access to your purchased digital product via the delivery method specified at the time of purchase. This may include a link to a GPT tool, a downloadable file, or access to a platform.
Digital products are delivered electronically. It is your responsibility to ensure you have the necessary technology and accounts to access the product, including a ChatGPT account where applicable.

4. Service Delivery
Services are delivered in accordance with the scope, timeline, and terms agreed at the time of engagement. For strategy sessions, delivery occurs during the booked call. For project and retainer work, delivery is governed by the client agreement.
We will make reasonable efforts to meet agreed timelines. Where delays occur due to circumstances outside our control or due to delayed receipt of required information or approvals from the client, we are not responsible for any resulting impact on delivery.
You agree to provide timely responses, approvals, and any information required for us to deliver services. Delays caused by late client responses may affect delivery timelines and do not entitle you to a refund or discount.
5. Lifetime Access
Where a digital product is sold with lifetime access, this means access for the lifetime of the product as we operate it. We reserve the right to modify, update, or discontinue any product at any time. Where a product is discontinued, we will endeavour to provide reasonable notice to existing customers.
Lifetime access does not guarantee access to future products or features that are released as separate offerings.
6. Intellectual Property
All content, frameworks, methods, copy, tools, and materials produced by or for Stratique are the intellectual property of Anya Canise trading as Stratique and are protected by applicable copyright and intellectual property laws.
6.1 Digital products
By purchasing a digital product, you are granted a personal, non-exclusive, non-transferable licence to use the product for your own business purposes. You may not:
Resell, sublicence, or distribute our products or any part of them to third parties
Share your access credentials or GPT tool access with others
Reproduce, copy, or distribute the frameworks, methods, or copy from our products without our written permission
Use our products to create competing products or services
Claim the S.E.L.L. Method™ or any associated frameworks as your own intellectual property
6.2 Service work product
Ownership of work product produced as part of a service engagement, including email copy, strategies, frameworks, and recommendations, is governed by your individual client agreement. Until full payment has been received, all work product remains the intellectual property of Anya Canise trading as Stratique.
7. Acceptable Use
You agree to use our products and services only for lawful business purposes. You must not use our products or any work product we produce to create content that is misleading, deceptive, harmful, or in violation of any applicable laws or platform policies including Meta advertising policies and email marketing laws including the Australian Spam Act 2003.
8. Refund Policy
8.1 Digital products
Due to the digital and immediately accessible nature of our products, we do not offer refunds once access has been delivered, except where required by Australian Consumer Law.
Under the Australian Consumer Law, you may be entitled to a remedy if a product has a major failure. A major failure occurs when a product does not do what it was represented to do, is not of acceptable quality, or is significantly different from its description.
Refund requests on the basis of change of mind or failure to read the product description before purchasing will not be considered.
8.2 Strategy sessions
Booked strategy sessions may be rescheduled with at least 24 hours notice.
Cancellations made with less than 24 hours notice or no-shows will forfeit the session fee.
Refunds are not available for completed strategy sessions.
8.3 Projects and retainers
Refund and cancellation terms for project and retainer engagements are governed by your individual client agreement.
In the absence of a client agreement, project fees paid are non-refundable once work has commenced.

9. Payment
Digital product payments are processed through our third-party payment provider at the time of purchase.
Strategy session fees are payable at the time of booking.
Project and retainer payment schedules are set out in the individual client agreement.
All prices are displayed in Australian dollars unless otherwise stated.
We reserve the right to change our pricing at any time. Price changes do not affect purchases already completed.
10. Limitation of Liability
To the maximum extent permitted by Australian law, Anya Canise trading as Stratique will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of or inability to use our products or services.
For digital products, our total liability to you will not exceed the amount you paid for the product in question.
For service engagements, our total liability is limited as set out in your individual client agreement, or in the absence of a client agreement, to the total fees paid for the specific service giving rise to the claim.
Nothing in these terms limits your rights under the Australian Consumer Law where those rights cannot be excluded by law.
11. No Guarantee of Results
Our products and services provide frameworks, tools, strategy, and copy to assist with email marketing. Results will vary depending on many factors including your business, your audience, your implementation, and market conditions.
We make no guarantee that use of our products or services will result in any specific business outcome, level of revenue, or commercial success. Please refer to our Pricing and Results Disclaimer for further information.
12. Third-Party Platforms
Our GPT products operate through ChatGPT, owned by OpenAI. We are not responsible for any changes to ChatGPT's platform, pricing, availability, or terms that may affect your access to our products. By using our GPT products, you also agree to OpenAI's terms of service and usage policies.
Service delivery may involve working within third-party platforms including email marketing platforms, website builders, and funnel tools. We are not responsible for the performance, availability, or terms of those platforms.
13. Confidentiality
We treat all information shared by service clients as confidential as described in our Privacy Policy. In return, you agree to treat any proprietary frameworks, methodologies, pricing information, or business processes shared by us in the course of service delivery as confidential and not to disclose them to third parties without our written consent.
14. Changes to These Terms
We reserve the right to update these Terms of Service at any time. Updated terms will be published on our website with a revised effective date. Your continued use of our website, products, or services after any changes constitutes your acceptance of the updated terms.
15. Governing Law
These terms are governed by the laws of Victoria, Australia. Any disputes arising from these terms or your use of our products or services will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
